Declaration of participation

To be part of these trips, the user must consider that:

I DECLARE:

I know that my participation in activities such as mountaineering, canyoning, trekking, hiking, mountain biking, rock climbing, camping and rope activities involves known, foreseeable and unforeseeable risks, which could lead to physical, emotional or psychological damage to myself or third parties, including death and Covid-19. I understand that, due to the very nature of these activities, these risks cannot be eliminated, being inherent to this kind of sport.

I declare that I participate voluntarily, freely, consciously and with full discernment in these activities.

I know and assume the risks derived from them, which, among others, could be caused by falls or blows originating from climbing or walking along natural paths, being hit by rocks, ice, branches or fallen objects from higher areas, elements or forces of nature — including lightning, wind, rain, snow, avalanches, meteorological phenomena and changes, falls on rocks and trails — exposure to insect bites, snakes or reptiles, animal attacks, the risks derived from altitude, cold or heat — including hypothermia and frostbite, heat stroke, Covid-19, acute mountain sickness, pulmonary or cerebral edema — swimming, or risks derived from my own physical, mental or psychological state or condition associated or related to the activities mentioned above.

In the same way, I declare that I have received, in due time, all the necessary and sufficient information about the activities I am going to carry out: route, difficulty, schedules, necessary equipment, necessary technical knowledge and action protocol.

I also declare that I am in good physical, mental and psychological condition, in accordance with the medical record prepared by the undersigned, which is attached to this instrument and has the character of a sworn statement.

Clarification

Pablo Zelaya Huerta reserves the right to cancel or modify scheduled activities for climatic or meteorological reasons, or those that could affect the safety of the group or individuals within the group, such as Covid-19.

Pablo Zelaya Huerta reserves the right of exclusion in case of observing behaviors that endanger or risk the safety of the individual or the group, including disrespect toward the environment or fellow participants, or disobedience to the guide or person in charge of the activity, without this implying any right to reimbursement.

Refund and cancellation

The program is considered cancelled when:

• Weather conditions expose the user to danger.
• The user is in poor condition to exert the required effort.
• The user faces risks that exceed their limits.
• The user does not have the appropriate gear for proper safety, as specified in the equipment forms.
• The user does not maintain a stable mental state.
• The user arrives before the start of the trip with injuries unrelated to the current activity.

A refund will be issued as long as:

• The refund system is linked to proposing other similar destinations, in case of force majeure affecting the company.
• The company reserves the right to modify the itinerary for proper management and safety, without this generating refunds.
• The user cancels the trip 3 months prior to the expedition.
• The participation deposit is non-refundable. It is considered a formality for both parties to confirm proper participation. Likewise, the spot within the expedition is cancelled.
